A businessman identified as Musa Habeeb, has begged an Upper Area Court in Kubwa, Abuja, to order his wife to leave his house as he has initiated moves to divorce her.
Habeeb told the court that told Mulikat Shuaibu of his plans to end their marriage three months ago but she refused to leave his house.
According to the applicant, he consulted his lawyer to get commence the divorce filing on December 18, 2023 and ordered his spouse to leave but she stayed.
“I consulted my lawyer, Abdulwaheed Yakubu to get a divorce letter from the court on Dec.18, 2023, which has been done. Shuaibu is no longer my wife, I want the court to order her to leave my house,” Habeeb pleaded.
Counsel to the wife, Sherifdeen Bello however said that the divorce does not exist, and for the marriage to be dissolved there are procedures in Islam that must be followed
“The procedures have not been followed, if the plaintiff claims to have divorced his wife, she has not observed “Iddah” which is a waiting period of three months according to Islamic injunction, before contracting another marriage,” Bello said.
He claimed that since Dec 10, Habeeb had not paid any money for maintenance to his wife, who is heavily pregnant, but paid on January 8, 2024 because the matter had been taken to court.
Bello applied for Habeeb to pay N80,000 to Shuaibu for feeding and maintenance and N14, 000 for gas monthly. He added that Habeeb should pay N100,000 for baby things for the unborn baby.
He also applied for Habeeb to continue to pay his daughter’s school fees and return the items he removed from their home since the matter started in court.
The plaintiff’s counsel, however, dismissed the allegations, noting that Habeeb was up and doing with his obligations in his home and urged the court to discountenance the application of the respondent.
The judge, Mohammed Wakili adjourned the matter until February 5.
